The following is made in lieu of all warranties, expressed or implied: Monument’s Equipment Bomat Ltd (refer as Bomats in the following terms and conditions) and/or manufacturer’s only obligation shall be to replace such quantity of the product proved to be defective provided that such guarantees or replacement are a stated policy of the manufacturer. Bomats and/or manufacturer shall not be liable for any injury, loss or damage, direct, incidental or consequential, arising out of the use of or the inability to use the product. Before using, user shall determine the suitability of the product for his intended use, user shall take necessary precautions to ensure his own health and safety and that of any others who may be affected by his work or activities, user shall understand overall work safety procedures, and user assumes all risk and liability whatsoever in connection herewith. The foregoing may not be altered except by an agreement signed by officers of Bomats.
Open and inspect cartons immediately upon receipt. Bomats will not accept claims filed over 48 hours after receipt.
The appearance of any item on any or all print or any electronic media does not guarantee the item is in stock, or available.
Return for repair or replacement
Bomats is limited to manufacturer’s warranty specifications. We may be in certain cases unable to issue an immediate credit or warranty repair, until approval is given by the manufacturer. However we do all possible to make sure your repair or replacement is quickly processed. Misuse or lack of maintenance is beyond our control, it may void your warranty. The client is responsible for using products the appropriate way and for planning its maintenance. Bomats will do all possible to make sure you receive fair treatment.
Claims for damaged goods must be filed with the carrier immediately and Bomats must be notified of claim within 48 hours. Bomats is not responsible for damages by carriers. Please check cartons upon arrival.
A return authorization number must be requested from Bomats before an eligible item may be returned. Bomats will not accept collect shipments on returns, unless pre-authorized. A 20% restocking charge may be applied to all returns. Return of non-stock items will be subject to manufacturer’s restocking fee, which may exceed 20%. Authorization for returns must be requested within 30 days of invoice date. All defective merchandise is subject to Vendor’s inspection. Returned items must be unused, missing no parts and be in a resalable condition to receive full credit. Eligible items returned after the above set time period, or in non-resalable condition, including marked or damaged manufacturer original packaging, will not be credited. No returns will be accepted or credit issued on used products, unless they are proven to be defective. No returns will be authorized on chemicals or adhesives. Customers must pay shipping charges on all returns. Upon receipt and inspection of the product return, Bomats will issue a refund on shipping charges if it is proven that there was a shipping error.
Special order items or products modified to customers’ specifications may not be returned. Special or urgent items requiring special freight charges, requested by the customer, may be charged.
By default, our pricing is based on our main warehouse as shipping point. Some items may be shipped from the manufacturer’s warehouse direct to customer if considered more economical or faster delivery is requested by the customer. Price and availability are subject to change without notice. Bomats reserves the right to correct pricing errors on any or all print or any electronic media.
Net 30 days with approved credit. A service charge of 1.5 % per month (18% per year) will be added to accounts over 30 days. Special terms or conditions must be approved prior to order processing. Any and all collection fees will be in addition to amounts owed to Bomats. For large equipment or machines, 30% down at order, 60% prior to shipping and 10% at installation is typical. However, these machinery terms may vary depending on manufacturer.
All orders will be shipped C.O.D. unless credit has been approved or the order has been prepaid. Returned cheques, exceeding terms or surpassing pre-established credit line would mean automatic suspension of credit privileges until credit is re-established. Orders shipped the same day must be received by 3:00 pm Eastern Standard Time (EST). Your order will be shipped prepaid and charged, unless specified otherwise.
